Work Injuries If you are a worker who is injured in Queensland as a result of your work duties, you will likely be covered by workers' compensation insurance. The insurer will vary depending on your employer, but is usually WorkCover Queensland. There are two distinct arms of workers' compensation insurance in Queensland being statutory claims and common law claims. A statutory claim will cover your wages and rehabilitation in the immediate aftermath of your injury. You, your employer and the insurer all have rights and responsibilities in relation to your treatment and rehabilitation. If your injury was not your fault, and you can establish that someone else caused or contributed to your injury, then you may be able to pursue a common law claim. These claims aim to compensate you for pain and suffering, past and future loss of earnings, any medical treatment you may require into the future and any care you may need. Injuries in Public Places Sometimes injuries occur outside of work or road situations. Where you suffer an injury in a public space or as part of an activity, there may be an avenue to pursue compensation for your losses. These types of claims are known as "public liability" claims and often can be quite complex. In order to pursue a claim, you must show that you have suffered an injury, and that injury was caused through someone else's negligence - that is that someone's actions or, in some cases, inactions, caused you injury. Compensation that can be claimed includes pain and suffering, loss of earnings, treatment and any care and assistance that has been required and that may be required in the future. Road Injuries All vehicles in Queensland are covered by Compulsory Third Party insurance which is included within the vehicles registration. If you have been injured in a road accident that was not your fault, you may be able to claim treatment and rehabilitation expenses from the insurer, and, if you have sustained significant losses, then you may also be able to pursue a common law claim. These losses include any loss of earnings, treatment and other out of pocket expenses not covered initially by the insurer, future treatment along with care and assistance and your pain and suffering. Even if a vehicle hasn't been registered, there are still avenues to pursue a claim, although there are even tighter time limits if a vehicle is unregistered or a vehicle cannot be identified.
